Robert Bleakley defended multiple claims brought against it by one of its employees for supposed injuries
sustained to her neck and shoulder while working in the company distribution center. The firm defended the
claims raising fraud and misrepresentation defenses arising out of, among other thigs, false testimony in which the
employee denied prior neck and shoulder pain. The employee also falsely denied any prior arrest record to an examining psychiatrist.
Claimant withdrew all claims at the final hearing and on September 12, 2019, the Judge of Compensation Claims awarded Advance Auto Parts
and its third party administrator, Sedgwick CMS, $8,028.26 in costs. Advance’ enforcement actions are pending.
